SMS/Text Messaging Privacy

Perkiomen Valley School District (“PVSD,” “the District,” “we,” “us,” or “our”) may offer SMS/text messaging programs to provide school-related informational and operational notifications, including alerts and notifications related to district services and applications such as PVSD Hall Pass.

Information We Collect

When you enroll in a PVSD text messaging program, we may collect and maintain information including your mobile telephone number, your SMS messaging preferences, records of your consent to receive text messages, and records relating to messages sent to or received from your mobile number.

How We Use Mobile Information

PVSD uses mobile telephone numbers and SMS consent information only for purposes related to the District’s authorized messaging programs and the school-related services for which the recipient has provided consent.

Text messages may include informational or operational notifications from PVSD. Message frequency varies depending on the program and activity associated with the service. Message and data rates may apply.

Mobile Information and Consent Are Not Shared for Marketing

PVSD does not sell, rent, share, or provide mobile telephone numbers, SMS opt-in information, or messaging consent data to third parties or affiliates for marketing or promotional purposes.

SMS consent is specific to PVSD and the messaging program for which consent was provided and is not transferred to another organization for that organization’s independent marketing or promotional use.

This restriction does not prohibit PVSD from using service providers that process information solely on the District’s behalf as necessary to operate or support the messaging service, subject to appropriate privacy and security requirements.

No mobile information — including mobile phone numbers and SMS/text-message opt-in data — will be sold, rented, or shared with third parties or affiliates for marketing or promotional purposes. Mobile numbers provided for Perkiomen Valley School District text programs are used only to deliver the messages the recipient opted into, and may be processed by our SMS provider (Twilio) solely to send those messages. Text STOP to unsubscribe or HELP for help; message and data rates may apply..

Opting Out

Participation in PVSD text messaging programs is voluntary. Recipients may withdraw consent and stop receiving messages from a messaging program at any time by replying STOP to a message from that program. After an opt-out request is processed, no additional messages will be sent through that messaging program unless the recipient subsequently provides consent again.

Recipients may reply HELP for assistance or contact Perkiomen Valley School District using the contact information provided on the District website.

Privacy and Security

PVSD takes reasonable administrative, technical, and organizational measures to protect personal information maintained in connection with its messaging programs. Information collected through SMS messaging is handled in accordance with this Privacy Policy and applicable District policies and legal requirements.

Notification: Student Complaint Process (Board Policy 219)

The Board recognizes that students have the right to request redress of complaints. Further, the Board believes that the reinforcement of respect for established processes is an important part of the educational process. Accordingly, individual and group complaints should be recognized, and appropriate appeal procedures should be provided.

Additionally, the Board declares it to be the policy of this district to ensure that all district programs and practices are free from discrimination against all qualified students with disabilities. The Board recognizes its responsibility to provide academic and nonacademic services and programs equally to students with and without disabilities.

Additionally, the Board declares it to be the policy of this district to provide to all persons equal access to all categories of employment in this district, regardless of race, color, age, creed, religion, sex, sexual orientation, ancestry, national origin, marital status, genetic information, pregnancy or handicap/disability. The district shall make reasonable accommodations for identified physical and mental impairments that constitute disabilities, consistent with the requirements of federal and state laws and regulations. 

§ 200.217 Whistleblower Protections

An employee of a recipient or subrecipient must not be discharged, demoted, or otherwise discriminated against as a reprisal for disclosing to a person or body described in paragraph (a)(2) of 41 U.S.C. 4712 information that the employee reasonably believes is evidence of gross mismanagement of a Federal contract or grant, a gross waste of Federal funds, an abuse of authority relating to a Federal contract or grant, a substantial and specific danger to public health or safety, or a violation of law, rule, or regulation related to a Federal contract (including the competition for or negotiation of a contract) or grant. The recipient and subrecipient must inform their employees in writing of employee whistleblower rights and protections under 41 U.S.C. 4712. See statutory requirements for whistleblower protections at 10 U.S.C. 470141 U.S.C. 471241 U.S.C. 4304, and 10 U.S.C. 4310.

In the event an individual believes they are being retaliated against for reporting information, i.e., whistleblowing, they should reference the reporting form in Policy 103 Discrimination/Title IX Sexual Harassment Affecting Students or Policy 906 Public Complaints to complete and submit to the Executive Director of Human Resources.
